Terms of Sale:

Purchaser agrees above items are sold AS IS, WHERE IS and With All Faults. NO WARRANTY or Guarantee is expressed or implied and each item is the sole responsibility of the purchaser from the moment the Auctioneer declares the item sold. ALL ITEMS MUST BE PAID FOR WITHIN 2 BUSINESS DAYS (END OF BUSINESS TUESDAY) AND SHIPPING ARRANGEMENTS MADE.

Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition. Mark Switzer Auction Services will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold as is with no guarantees expressed or implied, and that they may not return any item they purchase. Any Oral Statements made by the Auctioneer during the sale take precedence over written material, so it is strongly recommended that Bidders listen to the audio when bidding online. In the event the audio is not working, you should communicate with an operator, or refrain from bidding.

Mark Switzer Auction Services is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Mark Switzer Auction Services or anyone else if the Internet service fails to work correctly before or during the live auction. Mark Switzer Auction Services will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Mark Switzer Auction Services reserves the right to withdraw or re-catalog items in this auction.

Payment & Charges:

Payment must be made within 2 business days of the auction.
Acceptable Payments:
Cash
Credit Card- US ID required
- no credit cards over $4,000
- name on credit card must match buyer and ID
- there will be a 3.50% administrative fee on all credit card purchases.
Wire Transfer
Check - if $5,000 and over, if not established customer, we will hold merchandise until check clears bank, unless
customer has a Bank Letter of Guarantee.

Sales Tax will be charged to both In State and Out of State buyers, unless buyers furnish a Resale Certificate. Texas buyers who want to claim a Farm Use Exemption on farm equipment must present a valid Texas Agriculture & Timber Registration Number, along with a signed Texas Agricultural Sales and Use Tax Exemption Certificate. Out of state buyers can apply for a Texas Ag number through the Texas State Comptroller's office. The state of Texas charges a 2% diesel fuel surcharge tax on diesel off road equipment 50 horsepower or more. This tax is not charged if the equipment is for resale or farm use.

Buyers Premium:
A 10% Buyers Premium will be charged on the first $5000 per lot on all purchases. If purchasing online, the Online Fee of 5% will also apply, so a total of 15% .

Document Fee:
There will be a $50 Document Fee on any licensed, titled or bill of sale vehicle including trailers and ATV's.

Shipping
Shipping is the responsibility of the buyer. We do not ship. We have loaders and loading docks and will load your purchases. We can assist you in finding shippers, but any agreement is between the buyer and the shipper. Buyers are responsible for shipping costs.
