• TERMS: ALL ITEMS ARE SOLD AS-IS, WHERE-IS with no warranty or guarantee expressed or implied for description, condition, or fitness for use. Buyers will incur a 10% buyer's premium per item, capped at $500, along with a 3% internet provider fee, which has no cap. A 6% Pennsylvania state tax will apply to all purchases, except for items qualifying for farming use or resale after Wolgemuth Auction receives a proper sales tax exemption form. Sales tax will be applied to the invoice total, including Internet Premium. (Wire fees are not taxed),
Items purchased must be picked up within 30 days from the date of sale—NO EXCEPTIONS. Failure to do so may result in the resale of the items to cover storage fees.
**WIRE TRANSFER INSTRUCTIONS (IMPORTANT): ** You must include your Buyer Number and Sale Date as a reference in your wire transfer to ensure proper credit. Failure to do so may result in a delay in the release of your equipment, with subsequent storage charges. Domestic wire transactions will incur a $15 fee, while international wire transactions will have a $40 fee.

1. SALES TAX: Applicable State of PA Sales Tax (6%) will be charged on all purchases deemed taxable in accordance with State Laws unless you are exempt from Sales Tax and you provide a tax exemption form and exception certificates that are acceptable to the State of PA. Sales tax will be applied to the invoice total, including Internet Premium. (Wire fees are not taxed),

2. BUYERS PREMIUM: Online bidders who purchase items will incur a 10% Buyer's Premium per item, capped at $500. along with a 3% Internet Provider fee, which has no cap. (This 3% fee is in addition to Wolgemuth Auctions buyer’s premium)

PAYMENT: Payment in full must be made within 3 business days of auction in the form Credit Card, Cash, Wire Transfer, and Check
o If paying by check Wolgemuth Auction MUST RECEIVE the check in 3 business days, if they are unable to do so the customer must call the office and speak to management.
o There is an additional 4% fee for all credit card payments (AE, VISA, DISC, MC).

o All items must be removed within 30 days, failure to do so may result in potential storage fees and the resale of the items to cover such fees.

• WIRE TRANSFER (IMPORTANT): All winning bidders will receive an email after the sale with wire instructions within the email. You MUST include your Buyer Number and Sale Date as a reference in your wire transfer to ensure proper credit. Failure to do so may result in a delay in the release of your equipment, with subsequent storage charges.

3. TITLES: No titles will be given out on sale day. Titles will be mailed out by certified mail within 30 days.

4. LOADING: Our staff will assist buyers with loading their purchases but will not perform the securing and tie-down of the loads or the items. We are not liable for any items loaded or their securement. If you hire an outside transport company, ensure the driver can handle securing the load independently. Wolgemuth Auction and its employees are not responsible for any damage or injury that may occur.
Please note that Wolgemuth Auction does not provide shipping services through UPS, FedEx, USPS, or any mailing company. Buyers are responsible for arranging their own transportation or shipping methods.

5. TRUCKING: The buyer is solely responsible for arranging the transportation of their purchases. Failure to secure appropriate transportation within 30 days will not be considered a valid reason for not removing the purchased items by the specified removal date.

6. REMOVAL: No items can be removed until they are paid for in full. Items can be removed Monday through Friday, between 7:30 AM and 4:30 PM, and must be removed within 30 days after the sale date. Items not removed within this timeframe may be considered abandoned. Wolgemuth Auction will attempt to contact the buyer to arrange for item removal, after the allotted removal time, the items will be resold. It is the buyer's sole responsibility to remove all items within the specified timeframes.
o Any items not collected within two weeks of the sale date will forfeit all rights to refunds in the event they are lost, damaged, or stolen. Refunds will then be at the company's discretion.

7. PURCHASING ITEMS ONLINE: Wolgemuth Auction and (Equipmentfacts) accept no liability for loss or damage howsoever arising from any Lots not presented for sale.
8. The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer.

SPECIAL TERMS-
• Bidders who participate remotely and do not attend the live auction or preview equipment in person understand and accept that their ability to inspect items may be limited compared to an in-person examination. It is the sole responsibility of the bidder to determine the condition, age, authenticity, value, or any other relevant factor of the item.

• Wolgemuth Auction makes every effort to provide accurate and detailed descriptions; however, we accept no responsibility for any errors or omissions in catalog listings or verbal representations. All items are sold “AS IS” and “WHERE IS” without warranty or guarantee, either expressed or implied.

• Equipment is available for public inspection prior to the sale, and all descriptions are offered as a helpful guide only—not as a substitute for personal inspection or due diligence.

• Condition Terms:
o Running: This means when the machine arrived at our lot, Wolgemuth Auction was able to start the item using the key or, in some cases, with a battery pack. The machine was capable of moving forward and backward under its own power, unless otherwise stated.

o Non-Running: This indicates Wolgemuth Auction was unable to start the machine. Unless specified otherwise, the reason for the machine's non-running status is unknown.

o Salvage: This designation means that the engine and/or other significant components are missing. The machine is not currently operational and may require extensive repairs or parts.

• These definitions are provided to help clarify the item's condition, but ALL items remain AS-IS, WHERE-IS, with no warranties or guarantees.

• Bidders will be held personally liable for any bids made with their Bidding Number, with strict liability being enforced.

• The Auctioneers retain the authority to deny a bidding card to any applicant, the right to bid at this auction sale, and the discretion to withdraw such privilege at any point. The highest bidder for each Lot will be deemed the Purchaser, and in case of any dispute, the Auctioneers possess absolute discretion to resolve the matter or to re-offer the lot for re-sale."

• In the event a Bidder fails to pay for an item within the allotted timeframe given, (3 Business Days) the auction company may at their discretion, treat the purchased articles as property of the company and will hold possession and could resell such item without notice to and at the Buyers expense and recover from the Buyer any loss or cost incurred from resale.

• Any items not collected within two weeks of the sale date will forfeit all rights to refunds in the event they are lost, damaged, or stolen. Refunds will then be at the company's discretion.

• It is essential to inquire about any uncertainties before committing to a purchase. Serial numbers may correspond to different years, and we do not guarantee specific years, as this information is obtained from a third-party service, with displayed hours reflecting those visible on the machine. Any announcements made by the auctioneer on the sale day concerning this equipment take precedence over printed information.

• Auctioneers may, at any time, at their sole discretion and without notice or liability to the Bidder withdraw or cancel the sale of any lot or offer any lot in groups or with privilege.

• No sale shall be invalidated by the Buyer for any reason whatsoever. It is your sole responsibility to inspect each piece of equipment you wish to bid on. You must determine the condition of the machine and bid according to your own judgment.

• Upon Registration, the Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth signifying they are in full agreement with these terms.
