We Recommend that Bidders Preview Equipment Prior to Bidding or Contact Us Prior to the Auction to Speak with a Sales Representative. Any Errors made in Picturing or Describing Items/Equipment Does Not Negate the Buyers Responsibility to Pay Their Invoices. It is the Buyers Responsibility to Make Sure Each Item Meets His/Her Needs and Requirements Before Placing Any Bids. When Registering to Bid You Are Agreeing to All Terms and Conditions.

Payment Instructions: • All internet Buyer invoices must be paid 3 days after auction. All Checks must be made payable to Powers Auction Service. Wire Transfer Instructions will be attached to a copy of your invoice. All invoices will be emailed to you after the auction. Titled Vehicle Fee: • A $100.00 Doc Fee is applied to any titled vehicles purchased. Titles will be sent priority mail 15 Working Days after Auction.

All articles of merchandise are offered “As Is and Where Is” in units of measure as announced at the time of sale. No claim will be considered for allowance adjustment of recession of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer; Auctioneer may state the year of manufacture of certain equipment, however it is the responsibility of the buyer to ascertain, by his own means the correctness of year, model prior to bidding. The Auctioneer reserves the right to group, modify, increase, diminish or delete lots at his sole and absolute discretion. No lots may be removed until the conclusion of the auction; although, invoices are available for payment at any time. All lots must be removed within the time announced or posted at the sale at buyer’s sole cost and risk, and only in a manner approved by the auctioneer. All equipment used in connection with removal shall itself be removed with the purchased lots. Powers Auction Service/Hwy 64 Auctions has put forth every effort, in preparing the advertising for this auction, to provide accurate descriptions of all items. All property is sold “as-is” and it is the bidder’s responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. To enable customers to participate in our auctions on the internet via EquipmentFacts, without the travel expense and lost time, buyers will pay an additional fee equal to 5% of the purchase price when buying items on-line per each item. There is no fee to register, watch, listen, or to bid. These fees apply only to internet buyers. Taxes and fees are applicable to all buyers. No charges or fees apply to unsuccessful bidders. Cash, ACH, Checks, Visa, MasterCard, Discover, American Express or Wire Transfers accepted as Payment. There is a $30.00 fee for a wire transfers. There will be a Convenience Fee of 4% with items purchased with any major credit card. Register early to assure your approval for bidding at the auction. There is a $100.00 Doc Fee for all titled vehicles. In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and e-mail address at which they can be contacted. This is to insure good communication between Hwy 64 Auctions/Powers Auction Service and the bidder throughout any transactions. All sales are final. Acceptance of a final bid by the auctioneer constitutes a legal, binding sales contract, pursuant to the terms and conditions as stated. Auctioned items are purchased “as is” with no return option. The auction company reserves the right to refusal (approval to bid) anyone deemed to be a potential detriment to the conduct of the auction. All announcements made day of auction take precedence over any and all printed or verbal statements made prior to auction day. Bidder shall be the sole judge of value. Powers Auction Service/Hwy 64 Auctions is providing Internet pre-auction and live bidding as a service to bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Powers Auction Service or anyone else if the Internet service fails to work correctly before or during the live auction. Powers Auction Service will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Powers Auction Service reserves the right to withdraw or re-catalog items in this auction. Purchases become the responsibility of and shall be and remain at the risk of the purchaser immediately upon acceptance of his bid. It shall be the responsibility of the purchaser to insure his purchases immediately. All payments must be made the day of sale.
