Auction Terms & Conditions
It is the bidder's responsibility to read these Terms and Conditions in their entirety before bidding. By registering and placing a bid, each bidder acknowledges that they have read, understand, and agree to be bound by these Terms and Conditions.
For purposes of these Terms and Conditions, Howell Real Estate and Auction and Ceylon / Armstrong Auctions LLC, together with their owners, employees, agents, representatives, and affiliates, shall be collectively referred to as the "Auction Company." The owner(s) of the property being sold shall be referred to as the "Seller."
The Auction Company is acting solely as the agent for the Seller. All items are sold AS IS, WHERE IS, WITH ALL FAULTS, with no warranties or guarantees of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
Bidders are strongly encouraged to personally inspect all items prior to bidding. Descriptions, photographs, videos, and other information are believed to be accurate but are provided as a courtesy only and are not guaranteed. Lighting, weather, screen settings, and other environmental factors may affect the appearance of photographs. It is the bidder's responsibility to determine the condition, authenticity, age, completeness, value, and suitability of any item before bidding.
Information regarding mileage, hours, serial numbers, model years, measurements, or other specifications is obtained from the Seller and/or visual inspection and is believed to be accurate; however, the Auction Company makes no guarantee as to the accuracy of such information and shall not be held liable for discrepancies.
The Auction Company, its employees, agents, and the online bidding platform are not responsible for software malfunctions, internet interruptions, server failures, communication delays, power outages, or missed, late, delayed, or failed bids for any reason.
ALL SALES ARE FINAL. NO RETURNS. NO REFUNDS.
Item Removal
A loader will be available through Friday, August 28, 2026. After that date, loading will be by appointment only.
All purchased items must be removed within four (4) weeks following the auction unless prior arrangements have been approved by the Auction Company. Items not removed within four (4) weeks will be considered abandoned and shall become the property of the Auction Company, with no refund to the buyer. Such items may be resold or otherwise disposed of at the Auction Company's discretion.
The buyer is solely responsible for all loading, shipping, transportation, permits, insurance, and associated costs unless otherwise announced.
Payment
Invoices will be emailed following the close of the auction. If you do not receive an invoice within 24 hours, please contact the auction office at 712-260-9690.
Payment is due within two (2) calendar days following the auction unless otherwise announced. Accounts not paid within the required time may be subject to finance charges, collection costs, suspension of bidding privileges, and/or cancellation of the sale.
Accepted forms of payment include:
Cash
Good Check
Credit Card (4% conv. fee)
Wire Transfer ($20 fee)
A $30.00 fee will be charged for all returned checks.
No item may be removed until payment has been received and verified by the Auction Company.
Buyer's Premium
A 6.5% Buyer's Premium applies to all online purchases.
A 4% Buyer's Premium applies to all live purchases.
The Buyer's Premium is capped at $1,500 per item.
Sales Tax
Applicable state and local sales tax will be collected where required by law unless the buyer provides a valid tax exemption certificate acceptable to the Auction Company before payment is made. Buyers are responsible for determining their own tax obligations.
Vehicle Titles
Vehicle titles will be mailed to the purchaser after funds have cleared the financial institution or within two (2) weeks, whichever occurs first, unless otherwise required by law.
Reserve Prices
Certain items may be offered subject to a confidential reserve established by the Seller. The Auction Company reserves the right to reject any bid and declare a "No Sale" if the reserve price is not met.
Default by Buyer
If a successful bidder fails to pay for purchased items within the required time, the Auction Company may, at its sole discretion, cancel the sale, resell the item(s), and/or offer the item(s) to the next highest bidder. The defaulting bidder shall remain liable for any deficiency between the original purchase price and the resale price, together with any applicable Buyer's Premium, storage fees, collection costs, reasonable attorney fees where permitted by law, and any other damages or expenses incurred by the Auction Company or the Seller.
The Auction Company reserves the right to suspend or permanently revoke the bidding privileges of any bidder who defaults on payment.
Auction Company Rights
The Auction Company reserves the right to:
Withdraw any item before or during the auction.
Reject any bid or bidder.
Resolve bidding disputes at its sole discretion.
Reopen bidding if necessary to resolve a dispute.
Correct clerical, typographical, catalog, photograph, or clerking errors.
Cancel, postpone, or reschedule the auction due to circumstances beyond its control.
Refuse service to any person for lawful reasons.
Limitation of Liability
In no event shall the Auction Company, its owners, employees, agents, or representatives be liable for any indirect, incidental, consequential, punitive, or special damages arising out of participation in the auction or the purchase, ownership, transportation, or use of any item purchased.
Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the auction is conducted, without regard to conflict of law principles. Any legal action arising from or relating to the auction shall be brought exclusively in a court of competent jurisdiction located in the county where the auction is conducted, unless otherwise required by law.
Acceptance of Terms
Participation in the auction constitutes acceptance of these Terms and Conditions in their entirety.
