Cornerstone Realty & Auction – 2025 Fall Equipment Consignment Auction
1. AS-IS, WHERE-IS CONDITION
• All items are sold AS-IS, WHERE-IS, without any warranties whatsoever, whether express, implied, or statutory.
• All items are available for inspection. The auction site will be open 10:00-6:00 September 12th-18th and at 9:00 am the morning of the auction. Bidders are strongly encouraged to make their own in-person inspection prior to bidding.
• Cornerstone Realty & Auction assumes no liability for errors or omissions in listings.
2. TITLES, HOURS, AND INFORMATION
• All trailers are sold with NO TITLE unless otherwise stated.
• Hour meter readings and mileages are unverified; accuracy is not guaranteed.
• All information is gathered from sources believed to be reliable but is not guaranteed.
3. BUYER’S PREMIUM & FEES
• Online bidders: 7% buyer’s premium will be added to the hammer price.
• Onsite bidders: 5% buyer’s premium
• Wire transfer fees: $25 per domestic wire / $75 per international wire.
• Returned checks: $50 service fee.
• Moving/storage fees: $100 moving fee + $50/day storage after 7 days unless prior arrangements are made.
4. PAYMENT TERMS
• Payment must be made in full by 5:00 PM on the Wednesday following sale day.
• Accepted forms of payment:
o Wire transfer
o Certified/Cashier’s Check
o Cash
o Credit card (4% processing fee applies)
• Out-of-state and international buyers must pay by wire transfer.
• All items are subject to Kentucky sales tax, unless a valid resale certificate or Kentucky farm exemption number is provided. All exemption forms must be completed before tax is removed.
5. INVOICES & CONTACT
• Online winning bidders will receive an invoice via the email on file with EquipmentFacts.
• If not received within 24 hours, please call Cornerstone Realty & Auction at (859) 304-5051.
• Winning bidders must make contact within 24 hours of auction close to verify payment method.
6. PICKUP & LOADOUT
• Loadout begins 1 hour after sale starts and continues until 8:00 PM on auction day.
• Additional loadout: 10:00 AM – 4:00 PM the day after the auction.
• Monday–Saturday following auction: by appointment only (call 859-304-5051).
• Trucking is the responsibility of the buyer.
• Disassembly of equipment for shipping is the buyer’s responsibility.
• Cornerstone Realty & Auction is not responsible for damages during loading/unloading.
• Any equipment not picked up within 90 days reverts back to the Auction Company unless prior arrangements have been made.
7. BIDDING & DISPUTES
• The highest bidder for each lot shall be the purchaser.
• In the event of a tie, onsite bidder takes precedence.
• Once declared “SOLD,” bids cannot be retracted. Buyer is required to complete purchase.
• Seller, lienholder, or Auctioneer reserves the right to bid.
• Auctioneer has sole discretion to settle disputes or re-offer the lot.
• Cornerstone Realty & Auction is not responsible for missed bids due to internet failure or technical difficulties.
8. DEFAULT & RESALE
• All sales are final.
• Non-paying bidders will be prosecuted to the fullest extent of the law.
• Items not paid in full may be resold at public or private sale without notice. Buyer will be responsible for any deficit between their bid and resale price, plus all expenses of resale.
• Buyer indemnifies and holds Auctioneer harmless from all losses, expenses, or damages (including attorney’s fees) arising from buyer’s failure to comply.
• If Auctioneer cannot deliver purchase free of liens, liability is limited to refund of monies paid.
9. RISK & LIABILITY
• Purchases become the buyer’s responsibility immediately upon “SOLD.”
• Buyers must protect or insure their purchases immediately.
• Not responsible for accidents.
